New legislation came into effect on 6th April 2014 which affects the way that self-employed individuals are paid when they provide their services via an agency and are subject to supervision, direction or control ("control") by anyone. The new legislation means that where an individual is subject to control, or if anyone has the right to control them, the payment made to them must be subject to PAYE and National Insurance contribution (NIC) deductions.
These changes will become law on the 6th April 2014 and will affect all agencies and contracting companies.
We have identified that the alternative solution is to engage you on a contract of employment with TJW Contract Solutions Limited (Umbrella).
As an employee of TJW, you will benefit from all the advantages of being an employee. We will guarantee to pay you for a minimum number of hours per year, you will qualify for holiday pay, statutory government benefits and additional employment rights. You will be paid subject to deduction for PAYE and National Insurance but you will also be able to claim for legitimate expenses that you incur in carrying out your assignment. Because you will qualify for tax relief upon your expenses, you will be able to increase your take-home pay. It is important that you send us your expense claim form each week so that we can pay you the tax free expenses that you qualify for.
If you are happy to transfer to being an employee of TJW we will need to reregister you as an employee. An important part of this is establishing your right to work in the UK. If you are a British or EU citizen, and you have a passport, this is the only document we need to see. If you are from another country, or you do not have a passport, we will need to see further documentation from you.
